How Can We Help? Estate Planning Estate planning is an opportunity to arrange your affairs prior to death. It can involve everything from making a simple will to organising your assets through complex structures with family trusts, unit trusts, companies and other legal entities. Many business people already operate through those entities but do not realise that the interest and the assets in those entities may not pass under their will. Estate planning invariably involves making a will but may also include passing on powers as trustee or appointor to a trust, as well as nominations of superannuation entitlements and enduring powers of attorney (both financial and medical). These are sometimes referred to as "living wills". A Grant of Probate occurs upon a death when a will has to be proved to allow an executor to manage an estate. At Clancy & Triado, this is part of the service that we provide to our clients and is a natural complement to our family law practice which usually involves a rearrangement of people's assets.
