Our Denise van Dijk was interviewed by the Television Education Network on Primary Dispute Resolution, Pre Action Procedure and Less Adversarial Trials. Denise informed the viewers of the options available to people separating. One of the first options available to separating couples is mediation and round table conferences to try and resolve their differences in a friendly, without prejudice environment. Pre Action Procedures are legislated steps that lawyers must encourage clients to engage in first, before even considering Court proceedings. One of those requirements is to engage in Primary Dispute Resolution, to attempt to reach agreement.
Less Adversarial Trials (LATS) are a recent introduction to the Family Court of Australia. They are Trials conducted before a Judge, however they are less formal and more interactive than usual Trials in the Federal Magistrates Court (and some other Family Court Trials). LATS give parties the opportunity to address the decision making judges directly and have more involvement than other Trials. The aim of LATS is to make Court litigation less expensive, faster, and more tailored to individual circumstances and couples.
